Terms and conditions of use

Preamble

These General Terms and Conditions of Sale (hereinafter the “GTC”) govern all sales concluded on the website www.freevap.ch, operated by:

FREEVAP.CH is an online shop specialising in the sale of electronic cigarettes, e-liquids, accessories and vaping products.

Orders are prepared for rapid delivery throughout Switzerland. Prices displayed on the website include the applicable Swiss VAT. Customers domiciled in Switzerland do not incur any customs charges or import formalities when receiving their order.

The purpose of these GTC is to define the respective rights and obligations of FREEVAP.CH and its customers in connection with sales made through the website.

1. Purpose and scope

These General Terms and Conditions of Sale apply to all orders placed on the website www.freevap.ch .

By confirming an order, the Customer acknowledges having read these GTC and accepting them without reservation.

The applicable GTC are those in force on the date the order is confirmed.

FREEVAP.CH reserves the right to amend these GTC at any time. New provisions apply only to orders placed after they are published online.

If any provision of these GTC is declared null or unenforceable, the remaining provisions shall remain fully applicable.

2. Access to the website and use of services

The products marketed on FREEVAP.CH are intended exclusively for adults, in accordance with applicable Swiss legislation, in particular the Federal Act on Tobacco Products and Electronic Cigarettes (Tobacco Products Act, TPA).

Access to the products and the placing of an order are strictly reserved for persons aged 18 or over.

2.1 Age and identity verification

To comply with its legal obligations and ensure secure access to its products, FREEVAP.CH applies a mandatory age and identity verification procedure when a new customer places their first order.

This verification is carried out through our specialist partner IDnow, recognised for its secure identity verification solutions.

The Customer is asked to present a valid official document (identity card, passport or driving licence) and follow the various verification steps proposed by IDnow.

Once approved, this verification is not normally repeated for subsequent orders, except where required by law, following a significant change to account information or in the event of suspected fraud.

FREEVAP.CH does not have access to the identity documents submitted during this procedure and does not retain them. Processing carried out by IDnow is performed in accordance with its own privacy policy and the applicable data protection regulations.

FREEVAP.CH nevertheless reserves the right to request additional information or supporting documents where particular circumstances justify this, including suspected fraud, identity theft, misuse of the website or inconsistencies in the information provided.

If identity verification fails, the Customer refuses to follow the procedure or the Customer’s age cannot be confirmed, FREEVAP.CH may refuse or cancel the order.

2.2 Customer account

The customer account is strictly personal.

The Customer is responsible for the accuracy of the information provided when creating the account and for keeping login details confidential.

Any use of the account is deemed to have been made by its holder unless proven otherwise.

The Customer undertakes not to disclose login details to any third party or allow another person to use the account.

3. Products, availability and commercial offers

The products offered for sale are those shown on the website on the date of consultation, subject to availability.

FREEVAP.CH takes the greatest care in presenting products, their descriptions, photographs and the technical information provided.

Photographs, illustrations, visuals, colours, packaging and descriptions are provided for information only and are not contractually binding.

Manufacturers may change at any time:

  • the design of a product
  • its packaging
  • its labelling
  • certain aesthetic elements or accessories
  • provided that the essential characteristics of the product are not affected

Promotional offers are valid for the period during which they are published and while stocks last.

Prices displayed on the website are those in force at the time of consultation. They may be changed at any time before an order is confirmed.

The applicable price is the price displayed when the order is finally confirmed, subject to any obvious pricing error caused by a technical, computer or human error.

If a product becomes unavailable after an order has been confirmed, FREEVAP.CH will inform the Customer as soon as possible and, depending on the circumstances, offer:

  • a refund
  • an equivalent product, subject to the Customer’s agreement
  • or delayed shipment where replenishment is expected shortly

A refund for an unavailable product will be made no later than thirty (30) days after the decision to cancel the relevant product.

3.1 Use of promotional codes

Promotional codes are subject to the conditions stated when they are issued.

Unless otherwise stated, they cannot be combined with other commercial offers.

The welcome code may be used only once per customer and email address.

Any attempt to circumvent the promotional rules, in particular by creating several accounts or misusing several email addresses, may result in:

  • cancellation of the benefit granted;
  • cancellation of the order;
  • suspension of the relevant customer account.

FREEVAP.CH reserves the right to refuse any benefit obtained fraudulently or contrary to the spirit of the promotion.

4. Orders

Any order placed on the FREEVAP.CH website constitutes an offer by the Customer to purchase the selected products.

Confirmation of the order implies full and unconditional acceptance of these General Terms and Conditions of Sale.

The automatic email acknowledging receipt of the order does not constitute final acceptance of the order.

The sales contract is deemed concluded when the order is shipped by FREEVAP.CH.

FREEVAP.CH reserves the right to refuse, suspend or cancel any order, particularly in the following cases:

  • incomplete, incorrect or clearly inconsistent information
  • suspected fraud or identity theft
  • misuse of the website or promotional offers
  • a payment incident, including a previous one
  • inability to verify the Customer’s identity or age
  • failure to comply with these General Terms and Conditions of Sale
  • clearly abusive or bad-faith conduct

The Customer may request cancellation only while the order status is “payment accepted” or “order integrated”. A cancellation request does not guarantee immediate or effective cancellation. Customer service messages are handled one by one, from the oldest to the newest, and processing time must therefore be allowed. As our logistics operations are optimised to prepare orders very quickly, a cancellation request made while the order still had an eligible status may nevertheless be refused if, when it is processed, the parcel already has a tracking number and has been placed on a pallet for shipment. After this stage, the provisions of Article 9 concerning returns apply.

The Customer cannot request any amendment to an order (products, payment method, etc.). Once the order has been confirmed, customer service cannot make any changes. If cancellation is no longer possible, the provisions of Article 9 concerning returns apply.

5. Prices

Prices displayed on the website are stated in Swiss francs (CHF).

They include the applicable Swiss VAT and, where relevant, the statutory taxes in force, including the federal tax on vaping products.

Delivery charges are shown separately before the order is finally confirmed.

FREEVAP.CH reserves the right to change its prices at any time.

The applicable price is the price displayed when the order is confirmed.

Despite the care taken in updating the website, an obvious pricing error may exceptionally occur as a result of a technical, computer or human error.

In such a case, FREEVAP.CH reserves the right to cancel the relevant order after informing the Customer and to issue a full refund of any amounts paid.

Promotional offers, discounts, voucher codes and commercial benefits are valid only during their stated period and under the conditions specified when they are issued.

6. Payment

Orders may be paid only using the payment solutions offered on the website at the time of ordering.

Depending on the period, these methods may include:

  • Bank card
  • TWINT
  • PostFinance
  • Bank transfer
  • Payment by invoice via PowerPay
  • or any other payment method offered by FREEVAP.CH

Payment is due immediately when the order is placed, unless the Customer chooses a deferred payment method offered by an approved partner.

The order is considered confirmed only after payment has been accepted or the relevant financing provider has confirmed its approval.

If bank authorisation or financing is refused, or payment cannot be collected, the order will be cancelled automatically (status: “payment error”).

The Customer’s banking details never pass through FREEVAP.CH servers.

Payments are secured by partner payment providers using encryption protocols that comply with current security standards.

6.1 Payment by invoice – PowerPay

MF Group / POWERPAY, acting as an independent payment service provider, offers the “Payment by invoice” payment method. The order invoice allows you to pay for your online purchase conveniently by invoice. If you do not make payment within the prescribed period, you will retrospectively receive a monthly invoice the following month containing an overview of the order.

Upon conclusion of the purchase contract, POWERPAY acquires the invoice receivable and handles the payment arrangements. When purchasing by invoice, in addition to these General Terms and Conditions of Sale, you also accept POWERPAY’s General Terms and Conditions ( https://www.powerpay.ch/en/agb ).

When a Customer chooses payment by invoice, this service is provided by our partner PowerPay and offers a simple and secure payment solution. The invoice is sent separately by PowerPay, independently of the parcel shipment, using the selected communication channel (digital or postal). Use of this service incurs additional invoicing charges. For a first transaction, the authorised purchase limit is CHF 500.00 and the amount due must be paid within thirty (30) days of receipt of the invoice. For security reasons, the billing and delivery addresses entered must be strictly identical. As part of its risk assessment, PowerPay SA reserves the right to carry out a creditworthiness check with CRIF AG in Zurich before the order is approved.

Acceptance of payment by invoice is subject to PowerPay’s decision, particularly following its creditworthiness assessment. If payment is refused, FREEVAP has no information about the reasons for the decision and cannot intervene in the assessment process. The Customer should contact PowerPay directly for any information or request for reconsideration.

By choosing this payment method, the Customer agrees that the information required to process the application may be transmitted to PowerPay.

FREEVAP customer service cannot make any change to the billing or delivery address after the order has been accepted by PowerPay. The order will be shipped only to the address approved during the payment-by-invoice application.

Invoicing arrangements, payment deadlines, any charges, interest or reminder fees, and the consequences of late payment are governed exclusively by PowerPay’s General Terms and Conditions. FREEVAP has no access to information concerning invoices, payments made or outstanding receivables. For any question concerning an invoice or PowerPay account, the Customer must contact PowerPay customer service directly.

6.2 Creditworthiness check

For certain payment methods, particularly payment by invoice, FREEVAP.CH or its financial partner may carry out a creditworthiness check with specialist organisations such as CRIF or an equivalent organisation.

The sole purpose of this check is to prevent the risk of non-payment and secure transactions.

6.3 Fraud prevention

To ensure transaction security, FREEVAP.CH reserves the right to carry out any checks it considers necessary before shipping an order.

These checks may include:

  • the Customer’s identity
  • the Customer’s age
  • the consistency of the information provided
  • the billing address
  • the delivery address
  • the payment method used

For example, an additional check may be carried out in particular where:

  • the Customer is new
  • the delivery address differs from the billing address
  • the order amount is high
  • unusual behaviour is detected

FREEVAP.CH may request additional supporting documents.

If no response is received or if there are serious doubts as to the legitimacy of the order, the order may be suspended or cancelled.

6.4 Retention of title

The products remain the property of FREEVAP.CH until their price has been paid in full.

Risk nevertheless passes when the parcel is handed over to the carrier.

7. Delivery

7.1 Delivery area

FREEVAP.CH delivers exclusively within Switzerland and Liechtenstein and to the areas served by the carriers offered when the order is placed (excluding Büsingen and Samnaun).

All orders are prepared as quickly as possible to ensure rapid delivery to customers domiciled in Switzerland and the other areas served.

Prices displayed on the website include the applicable Swiss VAT. Customers do not incur customs charges or import formalities when receiving their order.

FREEVAP.CH reserves the right to refuse any order whose delivery address is located in an area that is not served (for example, where the Customer selects Switzerland instead of the actual country of the delivery address, including delivery locations in Büsingen or Samnaun).

If, despite FREEVAP.CH’s vigilance, an order is shipped to an unlisted and unsupported geographical area or country, the order will be refunded within 30 days after the parcel has been returned automatically by the postal service.

Any delivery charges invoiced and paid by the Customer when placing the order are not refundable where the Customer intentionally selected “Switzerland” or “Liechtenstein” as the country despite residing in another country that cannot be selected on the website (false declaration of the delivery country), and FREEVAP incurred the shipping costs for the parcel.

Please note that FREEVAP.CH may request and invoice additional charges to the Customer following charges imposed for automatic return of the parcel by the carrier to FREEVAP.CH, whatever the reason (incorrect address, name on the letter box not matching the name entered in the delivery address, moving home, false declaration of delivery country, etc.).

7.2 Delivery times

The delivery times stated on the website correspond to the times usually observed.

They are provided for information only and do not constitute a contractual commitment to achieve a particular result.

FREEVAP.CH makes every effort to ship orders as quickly as possible.

Delivery times may be affected in particular by:

  • carrier constraints
  • exceptional weather conditions
  • force majeure events
  • an exceptional logistics workload
  • administrative checks
  • any circumstance beyond the control of FREEVAP.CH

A delivery delay alone does not justify automatic cancellation of an order or give rise to compensation.

In the event of an abnormal delay, the Customer should contact customer service so that enquiries can be made with the carrier and an appropriate solution can be found for the circumstances.

The Customer is advised not to wait until all consumable supplies have run out. The Customer should make the necessary arrangements and anticipate orders as far as possible in order to deal with any internal or external disruption affecting FREEVAP.CH services.

7.3 Delivery charges

Delivery charges are shown before the order is finally confirmed.

Delivery is free under the commercial conditions displayed on the website at the time of ordering.

Below the free-delivery threshold, the applicable delivery charges are those shown when the basket is confirmed.

7.4 Shipment

Orders are shipped after payment has been confirmed or the chosen payment method has been accepted.

Orders confirmed before the cut-off time stated on the website are, except in exceptional circumstances, prepared and handed over to the carrier on the same day.

This information represents a logistics objective and must not be interpreted as a contractual guarantee.

7.5 Customer obligations

The Customer is solely responsible for the accuracy of the information provided when placing an order.

In particular, the Customer must check:

  • their identity
  • their delivery address
  • their billing address
  • their telephone number
  • their email address

FREEVAP.CH cannot be held liable for the consequences of an input error attributable to the Customer.

Transport costs incurred by FREEVAP.CH as a result of an incorrect or incomplete address may be invoiced to the Customer.

7.6 Receipt of the order

The Customer should check the apparent condition of the parcel upon receipt.

If the parcel is visibly damaged, open or otherwise abnormal, the Customer should make any appropriate reservations with the carrier and contact customer service as soon as possible.

Any complaint concerning:

  • a missing product
  • a preparation error
  • an incorrect item
  • an incorrect quantity
  • must be submitted within five (5) calendar days following receipt of the parcel

To facilitate handling of the case, FREEVAP.CH may request photographs of the parcel, its contents and its original packaging.

7.7 Undelivered parcels

Where a parcel is returned to FREEVAP.CH due to:

  • an incorrect address
  • an incorrect name or a name missing from the letter box
  • refusal to accept delivery
  • failure to collect the parcel from the carrier
  • an inability to deliver attributable to the Customer
  • FREEVAP.CH will inform the Customer if the Customer has not already reported the problem

The costs of reshipping may be invoiced to the Customer.

If the Customer requests cancellation of the order after the parcel has been returned for one of the reasons above, FREEVAP.CH may deduct the logistics costs actually incurred from the refund.

7.8 Lost parcels

Where a parcel is declared lost or presumed lost by the carrier, FREEVAP.CH opens an investigation with the carrier.

During the investigation, no refund or replacement shipment may be demanded, except where mandatory law provides otherwise.

At the end of the investigation, FREEVAP.CH will, depending on the circumstances:

  • send a replacement shipment
  • or issue a full refund for the order

7.9 Delivery with or without signature

Depending on the services offered when ordering, the Customer may choose between standard delivery without signature and delivery against signature.

Delivery without signature is the default delivery method offered by FREEVAP.CH. For the additional charge stated when ordering, the Customer may choose delivery against signature.

In accordance with Article 185 of the Swiss Code of Obligations (CO), unless mandatory law or an agreement provides otherwise, the benefits and risks associated with the goods pass to the buyer in accordance with Swiss law.

For delivery without signature, the carrier is authorised to deliver the parcel in accordance with its own delivery procedures, without handing it personally to the recipient.

FREEVAP.CH recommends delivery against signature for high-value orders or where the delivery location presents a particular risk.

If a delivery recorded as completed by the carrier is disputed, FREEVAP.CH will assist the Customer with the necessary steps involving the carrier and assess the case based on the information provided.

Where checks establish that the carrier properly completed delivery in accordance with the selected delivery method, FREEVAP.CH cannot be held liable for any disappearance, theft or damage occurring after delivery.

This article does not prevent FREEVAP.CH from offering, on a purely commercial basis and without acknowledging any liability or legal obligation, an appropriate solution where the particular circumstances of a case justify it.

8. Legal warranty and defective products

FREEVAP.CH guarantees the conformity of delivered products in accordance with the applicable provisions of Swiss law.

The Customer should report any defect as soon as possible after discovering it.

FREEVAP.CH may require the product to be returned so that it can be examined.

8.1 Commercial warranty

Unless otherwise stated, electronic equipment sold by FREEVAP.CH benefits from a commercial warranty of three (3) months from the delivery date.

This warranty covers only manufacturing or operating defects identified during normal use of the product in accordance with the manufacturer’s instructions.

8.2 Warranty exclusions

The following are excluded from all warranties in particular:

  • coils
  • cartridges
  • pods
  • atomisers
  • clearomisers
  • consumable tanks
  • wicks
  • seals
  • e-liquids
  • any component regarded as a consumable

The following are also excluded:

  • normal wear and tear
  • impacts
  • drops
  • liquid ingress
  • oxidation
  • misuse
  • disassembly or modification of the product
  • failure to follow the manufacturer’s recommendations

8.3 Warranty procedure

Before accepting a warranty claim, FREEVAP.CH may request:

  • photographs
  • a video
  • the product serial number
  • any useful information enabling the defect to be identified

The product may have to be returned before any decision is made regarding replacement or refund.

After examination, FREEVAP.CH will decide, depending on the nature of the defect, whether to:

  • repair the product
  • replace the product
  • refund the product where the first two solutions are not reasonably possible

The warranty is strictly limited to the product concerned and does not give rise to any additional compensation, except where mandatory law provides otherwise.

9. Right of revocation, cancellation and returns

9.1 Principle

Under Swiss law, distance contracts are not subject to a general statutory right of revocation or withdrawal.

Orders confirmed on the FREEVAP.CH website are therefore considered firm and final.

However, customer satisfaction is particularly important to FREEVAP.CH, and we undertake to seek an appropriate solution where a product is defective or non-compliant, or where an error is attributable to our services.

9.2 Cancellation before shipment

The Customer may request cancellation of an order provided that it has not yet been handed over to the carrier.

The Customer may request cancellation only while the order status is “payment accepted” or “order integrated”. A cancellation request does not guarantee immediate or effective cancellation. Customer service messages are processed one by one, from the oldest to the newest, and processing time must therefore be allowed. As our logistics operations are optimised to prepare orders very quickly, a cancellation request made while the order still had an eligible status may nevertheless be refused if, when it is processed, the parcel already has a tracking number and has been placed on a pallet for shipment. After this stage, the provisions of Article 9 concerning returns apply.

Once the order has been shipped or placed on a shipping pallet, it can no longer be cancelled.

The Customer cannot request any amendment to an order (products, payment method, voucher code, etc.). Once the order has been confirmed, it is firm and customer service cannot make any changes. If cancellation is no longer possible, the provisions of Article 9 concerning returns apply.

9.3 Return conditions

Returns are accepted only in the following cases:

  • the product delivered does not correspond to the order
  • the product has a manufacturing defect
  • a preparation error attributable to FREEVAP.CH
  • an ordering error by the Customer

All returns require prior approval from FREEVAP.CH.

Returned products must be:

  • complete
  • accompanied by any accessories
  • properly protected during return transport
  • in their original sealed packaging

For reasons of hygiene, health and consumer protection, products that have been opened, unsealed, filled, used or brought into contact with e-liquid cannot be returned, except in the event of a conformity or manufacturing defect.

Where FREEVAP.CH is responsible, the return arrangements will be communicated by customer service.

Returns made without prior approval may be refused.

9.4 Refunds

Where a refund is approved, it will be made using the payment method used for the order whenever technically possible.

The refund will be issued after the case has been approved and, where necessary, after the returned product has been received and inspected.

10. Special conditions applicable to vaping products

10.1 Products containing nicotine

Products containing nicotine are intended exclusively for adults.

They must be kept out of the reach of children and pets.

They must not be used by persons for whom nicotine consumption is not recommended or is contraindicated.

In case of doubt, the Customer should seek advice from a healthcare professional.

10.2 Product compatibility

The Customer is responsible for checking the compatibility of the ordered products with their equipment before confirming the order.

FREEVAP.CH cannot be held liable for an incompatibility resulting from a choice made by the Customer.

10.3 Consumables

Coils, cartridges, pods, wicks, seals, e-liquids and other consumables have a variable service life depending on the conditions of use.

Their regular replacement is part of normal product use and does not constitute a manufacturing defect.

10.4 Battery life

Battery-life figures communicated by manufacturers are provided for guidance only.

Battery life varies in particular according to:

  • the power used
  • the type of coil
  • frequency of use
  • ambient temperature
  • natural ageing of the battery

Battery life below the manufacturer’s estimates does not necessarily constitute a defect.

10.5 Condensation and leaks

Depending on conditions of use, transport, temperature, altitude or filling, slight condensation or minor leakage may occur.

These phenomena are inherent in the operation of certain electronic cigarettes and do not necessarily constitute a manufacturing defect.

10.6 Manufacturer changes

Manufacturers may change non-essential product characteristics at any time, including:

  • packaging
  • colour
  • markings
  • included accessories
  • certain aesthetic elements

Such changes do not engage the liability of FREEVAP.CH provided that the essential characteristics of the product remain unchanged.

11. Promotions, gifts and commercial programmes

Promotional campaigns are valid during their stated period and while stocks last.

Gifts offered as part of a commercial campaign cannot be refunded, exchanged or compensated.

FREEVAP.CH reserves the right to cancel any promotional benefit obtained fraudulently or contrary to the conditions of the offer.

12. Customer service and complaints

Any request concerning an order must be sent to customer service as soon as possible.

To facilitate the handling of a complaint, FREEVAP.CH may request:

  • photographs
  • videos
  • the batch or serial number
  • any document useful for assessing the case

By accepting these GTC without reservation, the Customer undertakes to cooperate in good faith by providing the information requested by customer service so that the matter can be resolved quickly.

FREEVAP.CH always favours seeking an amicable solution suited to the circumstances of each case.

13. Limitation of liability

FREEVAP.CH makes every effort to ensure the quality of the products marketed and the proper operation of its services.

FREEVAP.CH’s liability is limited to direct damage resulting from a fault attributable to it, within the limits provided by Swiss law.

FREEVAP.CH cannot in particular be held liable for damage resulting from:

  • use of products that does not comply with their intended purpose
  • failure to follow the manufacturer’s recommendations
  • incompatibility between several products selected by the Customer
  • modification or repair carried out by the Customer or a third party
  • normal wear and tear of consumables
  • improper storage of products
  • an act attributable to the carrier or any other third party
  • a force majeure event

To the extent permitted by applicable law, FREEVAP.CH’s liability is limited to the amount actually paid by the Customer for the order concerned.

FREEVAP.CH cannot be held liable for indirect damage, loss of business, loss of profit, loss of data or any other non-material loss.

14. Force majeure

FREEVAP.CH cannot be held liable for any delay, suspension or failure to perform its obligations where this results from an event beyond its control.

The following are in particular considered force majeure or equivalent events:

  • natural disaster
  • fire
  • flood
  • pandemic or epidemic
  • war
  • terrorist act
  • industrial action or strike
  • major computer failure
  • cyberattack
  • exceptional supply shortage
  • customs blockage
  • administrative decision
  • failure of a carrier
  • interruption of telecommunications networks or electricity supply

FREEVAP.CH’s obligations are suspended for the entire duration of the event.

15. Protection of personal data

FREEVAP.CH processes its Customers’ personal data in accordance with applicable Swiss data protection legislation, in particular the Federal Act on Data Protection (FADP).

The data collected is used only for:

  • processing orders
  • managing the customer relationship
  • verifying age and identity where required by law
  • preventing fraud
  • complying with legal obligations
  • improving the services offered

Certain data may be transmitted to service providers involved in fulfilling orders (carriers, payment providers, creditworthiness-check organisations, etc.), only to the extent necessary for them to perform their tasks.

The Customer has the rights provided by applicable legislation in relation to their personal data.

Full details of data processing are set out in the Privacy Policy available on the website.

16. Intellectual property

All elements available on the FREEVAP.CH website, including texts, photographs, illustrations, logos, trade marks, videos, databases, graphic charters and content, are protected by intellectual property rights.

Any reproduction, representation, distribution, extraction or use, whether total or partial, without the prior written permission of FREEVAP.CH is prohibited.

17. Changes in regulations

Products marketed by FREEVAP.CH are subject to the Swiss regulations applicable at the time they are offered for sale.

If a legislative or regulatory change makes it impossible to market, ship or possess an ordered product, FREEVAP.CH may cancel the relevant order and refund any amounts paid.

FREEVAP.CH cannot be held liable for the consequences of a regulatory change beyond its control.

18. Partial invalidity

If any provision of these General Terms and Conditions of Sale is declared null, invalid or unenforceable by a competent authority, the remaining provisions shall remain fully valid.

FREEVAP.CH’s failure to rely on a provision of these GTC at any given time shall not be interpreted as a waiver of its right to rely on that provision subsequently.

19. Applicable law and competent jurisdiction

These General Terms and Conditions of Sale are governed exclusively by Swiss law.

In the event of a difficulty, the Customer should first contact customer service in order to seek an amicable solution.

If no amicable agreement can be reached, the competent courts shall be determined in accordance with the mandatory provisions of Swiss law.
